Prejudicial dunning procedure

In the pre-litigation dunning procedure, we inform your debtor about your outstanding claims. The latter can either pay the amount owed immediately or ask us as FairCollect to contact him or her.

If it is not possible for the debtor to pay the debt on time and in full, we offer an individual solution.

Judicial dunning procedure

If we are unsuccessful with this approach and our solution offers, the next step is to contact the competent dunning court. This court will examine our application and serve the debtor with a court order to pay. (This, by the way, suspends the impending statute of limitations for your claim.) The person who has thus been reminded by the court then has 14 days to comply with the request for payment or to file an objection if he or she considers the claim to be unfounded.

If they do neither, you have the option of applying for an enforcement order after the two weeks have expired. The court "title" thus obtained confirms your outstanding claim and is the basis for enforcement.

Postjudicial dunning procedure

The sending of the enforcement notice automatically initiates the post-judicial dunning procedure. And FairCollect will of course continue to support you in enforcing your legal claim.

Through regular checks, we keep an eye on your debtor's ability to pay and as soon as something changes in the financial situation, we immediately resume processing your collection case.

Even if your claim is time-barred, stay confident: we may still be able to enforce it.
